1. Who We Are and What This Policy Covers
This Privacy Policy is issued by FMWC, LLC, doing business as Functional Medicine & Wellness Center (“the Practice,” “we,” “us,” or “our”), located at 1001 Cross Timbers Rd #1020, Flower Mound, TX 75028. It describes how we collect, use, disclose, and protect personal information gathered through the website at www.functionalmedicinecenter.com (the “Site”).
This policy applies only to the Site. It does not apply to information collected offline, in person at our office, by telephone during the course of care, or through any patient portal or clinical system.
2. Important Note About Health Information (PHI)
This Site is an informational website. It is not designed or intended to collect medical records, clinical information, or protected health information (“PHI”) as defined under HIPAA. Please do not submit symptoms, diagnoses, medications, test results, or other detailed health information through the Site’s forms. Health information you share with us as a patient — in the office, over the phone in connection with care, or through clinical channels — is governed by our Notice of Privacy Practices, a separate document available upon request at our front desk.
3. Information We Collect
We collect the following categories of information through the Site:
- Careers application data. When you apply through our careers form, we collect your name, email address, phone number, the position you are interested in, your message, and the résumé you upload, along with the date and time of your submission. Appointments are booked through our practice-management provider’s own pages, under its own privacy policy.
- Communications data. If you email, call, or text us in response to the Site, we retain the content of those communications.
- Usage and analytics data. Like most websites, we and our analytics provider (Google Analytics 4) automatically collect technical information such as IP address, browser type, device type, operating system, referring pages, pages visited, and time spent on the Site.
- Cookies and similar technologies. Small data files stored on your device that support Site functionality, spam prevention (such as reCAPTCHA), and measurement of Site usage through Google Analytics 4. See Section 9.
- Call recordings and call-tracking data. If we implement call-tracking technology, calls placed to tracking numbers displayed on the Site may be recorded or logged (caller number, duration, and, where permitted by law, call audio) for quality assurance and marketing measurement. Where recording occurs, you will be notified at the start of the call as required by applicable law.
4. Sources of Information
We collect personal information from the following sources:
- Directly from you, when you submit a form, book an appointment, call, email, or text us;
- Automatically from your device and browser, through cookies and similar technologies; and
- From service providers that operate the Site and its features on our behalf (for example, form-processing and spam-prevention services).
5. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and appointment requests and communicate with you about them;
- Schedule, confirm, reschedule, and follow up on appointments;
- Send you text messages you have opted in to receive (see Section 8);
- Operate, maintain, secure, and improve the Site, including detecting and preventing spam, fraud, and abuse;
- Understand how visitors use the Site so we can improve its content and performance;
- Comply with legal obligations and enforce our legal rights; and
- Fulfill any other purpose disclosed to you at the time of collection, with your consent where required.
6. How We Disclose Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising (as those terms are defined under the California Consumer Privacy Act as amended by the California Privacy Rights Act, and under comparable state laws, including the Texas Data Privacy and Security Act). We disclose personal information only as follows:
- Service providers. We disclose information to vendors that perform services on our behalf under contractual confidentiality obligations, in these categories: (a) website hosting and content delivery providers; (b) form processing and spam prevention providers (our website forms are processed by our website vendor, CI Web Group, through its form endpoint, and protected by Google reCAPTCHA); (c) analytics providers (Google Analytics 4, loaded through Google Tag Manager); and (d) communications providers (email, SMS, and telephone/call-tracking services) used to respond to you.
- Legal compliance and protection. We may disclose information when required by law, subpoena, or court order, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud or abuse.
- Business transfers. If the Practice is involved in a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of that transaction, subject to this policy’s protections.
7. Your Privacy Rights
7.1 Texas Residents — Texas Data Privacy and Security Act (TDPSA)
Texas residents may have the following rights under the TDPSA, subject to its applicability thresholds and exemptions:
- To confirm whether we process your personal data and to access that data;
- To correct inaccuracies in your personal data;
- To delete personal data provided by or obtained about you;
- To obtain a portable copy of personal data you provided to us, where technically feasible;
- To opt out of the processing of personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects (we do not engage in any of these activities);
- To appeal a refusal to act on a rights request. If we deny your request, you may appeal by replying to our decision, and if your appeal is denied you may contact the Texas Attorney General at https://www.texasattorneygeneral.gov.
Note: many small businesses are exempt from portions of the TDPSA; however, even small businesses may not sell sensitive personal data without consent, and we do not sell personal data of any kind. We honor the rights above voluntarily regardless of whether the statute strictly applies to us.
7.2 Visitors From California and Other States
If you reside in California or another state whose privacy law grants you rights (such as Colorado, Connecticut, Virginia, Utah, or Oregon), you may have similar rights to know/access, correct, delete, and obtain a copy of your personal information, and to opt out of sale, sharing, or targeted advertising. We do not sell or share personal information as those terms are defined under the CCPA/CPRA, and we have not done so in the preceding 12 months. We do not use or disclose sensitive personal information for purposes requiring a right to limit. We will not discriminate against you for exercising any privacy right.
7.3 Your Privacy Choices — California
Do Not Sell or Share My Personal Information. We do not sell your personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined by the California Consumer Privacy Act as amended by the CPRA. Because we do not engage in either activity, there is no sale or sharing for you to opt out of. If that ever changes, we will update this section and provide a working opt-out mechanism before any such processing begins.
We honor browser-based opt-out preference signals, including the Global Privacy Control (GPC). When a GPC signal is present we treat it as a valid request to opt out of sale/sharing and decline non-essential advertising cookies for that browser automatically. See Section 9 for details on cookies, analytics, and consent.
7.4 How to Exercise Your Rights

We will verify your identity using reasonable means (typically by matching the contact information you provide against our records) and respond within the time required by applicable law (generally 45 days, extendable where permitted). You may use an authorized agent where applicable law allows; we may require proof of the agent’s authority.
8. SMS / Text Messaging Consent (TCPA & A2P 10DLC Disclosure)
By texting us first, you give your express written consent to receive text messages from Functional Medicine & Wellness Center at the number provided, including messages sent using automated technology, regarding your inquiry, appointment scheduling, appointment reminders, and follow-up related to your request. Consent is not a condition of purchasing any goods or services or of receiving care.
- Message frequency varies based on your interaction with us.
- Message and data rates may apply.
- Reply STOP to cancel at any time; you will receive a single confirmation message and no further texts. Reply HELP for help, or contact us at [email protected] or 214-395-7264.
- Carriers (e.g., AT&T, Verizon, T-Mobile) are not liable for delayed or undelivered messages.
- Mobile opt-in data and consent records are not shared with third parties for their own marketing purposes. Mobile information is shared with our SMS service provider only as necessary to deliver messages.
9. Cookies, Analytics, and Do-Not-Track / Global Privacy Control
The Site uses cookies and similar technologies for core functionality and spam prevention (Google reCAPTCHA protects our forms, and its use is subject to Google’s privacy policy and terms). We use Google Analytics 4, loaded through Google Tag Manager, to measure how the Site is used; it sets cookies and collects usage data such as pages viewed, device and browser type, and approximate location. Google Consent Mode applies the choice you make in our cookie banner, and in regions where the law requires opt-in consent, analytics and advertising storage stay off until you agree. We will update this policy before adding any call-tracking service.
You can control cookies through your browser settings, including blocking or deleting them (some Site features may not function without them). We honor Global Privacy Control (GPC) signals where applicable law treats them as a valid opt-out of sale, sharing, or targeted advertising — and because we do not sell or share personal information, no further action is generally needed. The Site does not currently respond differently to browser “Do Not Track” signals, for which no uniform standard exists.
10. Third-Party Websites and Services
The Site may contain links to third-party websites and services (for example, review platforms, maps, or social media). Those sites operate under their own privacy policies, and we are not responsible for their practices. We encourage you to review the privacy policy of any site you visit.
11. Children’s Privacy (COPPA)
The Site is a general-audience website intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Site. If you believe a child under 13 has submitted personal information to us, please contact us at [email protected] and we will promptly delete it. Appointment requests for minor patients should be submitted by a parent or legal guardian.
12. Data Retention
We retain personal information collected through the Site only as long as reasonably necessary for the purposes described in this policy — typically, for as long as needed to respond to your inquiry, maintain our business records, comply with legal, regulatory, insurance, and professional-recordkeeping obligations, and resolve disputes. When information is no longer needed, we delete it or de-identify it.
13. Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information — including transmission of form data over encrypted (HTTPS) connections and spam and abuse prevention. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. Please avoid including sensitive information in website form submissions.
13.1 Payment Security
We do not collect or store payment card numbers on this website. Online booking and any online payments are handled by our third-party practice-management provider on its own secure pages, and in-office payments are processed by our payment processor. Those providers handle card data under their own security practices and the Payment Card Industry Data Security Standard (PCI DSS).
14. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date at the top of this page, and, for material changes, we will provide additional notice as required by applicable law. Your continued use of the Site after an update constitutes acceptance of the revised policy.
